Please read these Terms and Conditions carefully before using Harvested.

Acceptance of These Terms

These Terms and Conditions govern Your access to and use of the Harvested mobile application and related services (the "Service"). By registering for an Account, signing in, continuing as a guest, or otherwise using the Service, You confirm that You have read and agree to these Terms and Our Privacy Policy.

If You do not agree to these Terms, You must not access or use the Service.

Eligibility and Legal Use

The Service is intended only for adults who are 21 years of age or older. By using the Service, You represent and warrant that You are at least 21 years old.

You are solely responsible for ensuring that Your access to and use of the Service, including any activity or Content related to cannabis cultivation, is lawful in Your country, state, province, or other jurisdiction. The Service does not encourage or authorize illegal activity.

Definitions

• Account means an account created to access the Service.
• Application means the Harvested mobile application.
• Company, We, Us, or Our means Ekaterina Lashko, an individual entrepreneur registered in Armenia and the operator of the Harvested Service.
• Content means text, photographs, images, comments, diary entries, forum posts, messages, profile information, or other material submitted, posted, or shared through the Service.
• You or User means the individual accessing or using the Service.

User Accounts

You must provide accurate and current information when creating or maintaining an Account. You are responsible for safeguarding Your credentials and for activity performed through Your Account.

You must notify Us promptly if You believe that Your Account has been accessed without authorization. You may not impersonate another person or use a username that is unlawful, offensive, vulgar, misleading, or infringes another party's rights.

User-Generated Content

Your Content

You retain ownership of Content You submit to the Service. By submitting Content, You grant Us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and process that Content only as reasonably necessary to operate, improve, secure, and moderate the Service.

You represent that You own Your Content or have all rights required to submit it, and that Your Content does not violate the rights of any person or applicable law.

Zero-Tolerance Policy

The Company has zero tolerance for objectionable Content or abusive Users. You must not post, upload, transmit, or share Content that is unlawful, threatening, harassing, abusive, hateful, discriminatory, defamatory, obscene, sexually explicit, violent, fraudulent, invasive of privacy, or otherwise objectionable.

Prohibited Content and conduct include, without limitation:

• bullying, harassment, intimidation, threats, or abuse;
• hate speech or discrimination based on race, ethnicity, nationality, religion, sex, gender, sexual orientation, disability, or another protected characteristic;
• pornographic, sexually exploitative, graphically violent, or otherwise obscene material;
• spam, scams, deceptive information, unauthorized advertising, or impersonation;
• Content that infringes copyright, trademark, privacy, publicity, or other rights;
• malware, harmful code, attempts to gain unauthorized access, or activity that disrupts the Service;
• Content or conduct that promotes or facilitates illegal activity.

Filtering, Reporting, and Blocking

Before publication, textual User Content may be automatically screened for a limited set of severe slurs, including certain racial, ethnic, sexual-orientation, gender-identity, and similar discriminatory slurs. Content identified by this filter may be prevented from being published.

Automated screening is limited and may not detect every instance of objectionable Content. Passing the automated check does not mean that Content complies with these Terms. Users can report objectionable Content and abusive behavior using the reporting tools available for diaries, comments, forum content, and User profiles.

Users can block abusive Users. When a User is blocked through the complaint flow, the report is sent to the Company and that User's Content is immediately removed from the reporting User's feed. Users can also hide individual supported Content and manage blocked Users and hidden diaries in the Ban List.

The Company reviews reports of objectionable Content and abusive behavior and will take appropriate action within 24 hours of receiving a report. Appropriate action may include removing the offending Content and suspending or permanently terminating the Account of the User responsible for that Content or behavior.

We may remove Content, restrict access, preserve evidence, or take other action when We reasonably believe that Content or conduct violates these Terms, applicable law, or the safety of Users or the Service.

Educational Information

Materials provided through the Service, including cultivation information, Academy courses, calculators, and community discussions, are provided for general informational and educational purposes only. They are not medical, legal, or professional advice and are not a substitute for advice from a qualified professional.

Intellectual Property

The Service, excluding User Content, and its original software, design, branding, and other materials are owned by or licensed to the Company and are protected by applicable intellectual property laws.

If You believe Content available through the Service infringes Your copyright, contact Us at harvested.app@gmail.com and identify the copyrighted work, the allegedly infringing material, its location in the Service, and Your contact details.

Feedback

If You provide suggestions or feedback, You grant Us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to use that feedback to improve or develop the Service without restriction or compensation.

Third-Party Links and Services

The Service may contain links to websites or services that are not owned or controlled by the Company. We are not responsible for their content, availability, security, or privacy practices. You should review the terms and privacy policies of any third-party service You use.

Termination

We may suspend or terminate Your Account, remove Content, or restrict access to the Service if You violate these Terms, create a safety or legal risk, abuse other Users, or misuse the Service.

You may stop using the Service at any time and may permanently delete Your Account through the Account settings available in the Application. After You successfully confirm deletion, Your Account, profile, diaries, diary photographs, messages, comments, forum posts and replies, and all other User Content You created through the Service are permanently removed from the Service immediately. Account deletion cannot be undone.

Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, the Company disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted or error-free operation.

The Company does not guarantee the accuracy or legality of User Content and is not responsible for actions Users take based on information available through the Service.

Limitation of Liability

To the maximum extent permitted by applicable law, the Company and its service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business interruption arising from or related to use of the Service.

Some jurisdictions do not allow certain limitations or exclusions, so some of the above limitations may not apply to You.

Governing Law

These Terms are governed by the laws of Armenia, excluding conflict-of-law rules, except where mandatory laws in Your jurisdiction apply.

Changes to These Terms

We may update these Terms from time to time. We will provide reasonable notice of material changes through the Service or another appropriate channel. If You do not agree to updated Terms, You must stop using the Service.
